Legal Separation Lawyer Serving Seward, NE

Legal separation is different from divorce. Divorce is the legal dissolution of a marriage. Legal separation keeps the marriage intact, but each spouse lives separately. Finances, property, and assets are divided. Child custody and financial support can still be awarded. Since couples who are legally separated are still married, they can keep essential benefits, like health insurance. However, neither spouse is able to remarry unless they divorce (and being legally separated does not change the 180 day remarriage waiting requirement post-Decree of Dissolution)

Either party to a marriage may file a Complaint for legal separation at any time. In Nebraska, you can only file for divorce if at least one spouse has lived in the state for a year or more, or if you were married in Nebraska and lived there for the duration of the marriage. Legal separation does not have these requirements, making it often the best available choice for couples who do not meet the residential divorce requirements, but need to start legal processes. Additionally, if a divorce will negatively impact a family because of military benefits or citizenship concerns, legal separation is a viable alternative.

To initiate the legal separation process, you must formally file a Complaint with the courts. Your spouse is served or files a Voluntary Appearance and is given an opportunity to respond. If s/he/they do not respond, you may obtain a default separation.. In many situations, an agreement is reached through negotiations or mediation. The final agreement is submitted to the court for approval, and only after that step is it enforceable.

Why Experience Matters in Legal Separation Cases

Working with a legal separation lawyer is essential to protect your rights and best interests. Our attorneys will advocate for a fair division of property, help establish a parenting plan, and explore options for child or spousal maintenance. If you decide to divorce later, the conditions in the legal separation agreement will be considered. Therefore, it is important to come to a resolution that addresses your needs now and in the future.
